Tax mediation

Since 2005, mediation in tax cases has obtained a very modest place as an alternative way to resolve a dispute. Emotions may run high on both sides, especially during tax audits. Taxpayers may often feel very intimidated by their duty to provide information and the means that the tax authorities have to exercise their power through the increased burden of proof. With regard to Dutch tax audits, it is now possible to apply legal remedies against a request for information (a so-called information decision), but mediation can also be used to find a way out of the deadlock.

Tax mediation is organised both by the tax authorities and by way of referral by the court.
